New legislation effective January 2027

Legal basis for e-invoicing
Depending on your revenue or the agreed-upon format, you may currently still be subject to one of the transition periods scheduled from January 1, 2025, to December 31, 2027. All companies with prior-year revenue exceeding 800,000 euros are required to use the e-invoice format starting January 1, 2027. You can find the exact details regarding classification under these deadlines in Section 27(38) of the German Value Added Tax Act (UstG).
The basis for the newly introduced regulation is the so-called “VAT in the Digital Age (ViDA).” This involves the future introduction of a transaction-based reporting system for EU turnover, which is linked to a Europe-wide e-invoicing requirement. The first step is set forth in the Growth Opportunities Act. Domestic B2B transactions must be provided and received in a structured electronic format.
A wide variety of formats (e.g., Peppol, ZuGFeRD, Xrechnung, EDI) are already in use across Europe for this purpose. The Growth Opportunities Act does not explicitly prescribe either the formats or the transmission method for electronic data. The format used must simply contain complete and traceable data regarding the invoice.
